If I recall correctly, the intent was exile, not necessarily execution.  The waterfall wasn't meant to kill him, it was meant to keep him from coming back.

Legally the intent was exile.  The strip in question was dripping with sarcasm though; they were clearly intending to kill him, just not "technically."  Wouldn't be their fault if on the way to exile he shouldn't happen to survive.

Course, surviving a fall over a waterfall in a barrel is actually doable.  Not practical, of course, but several people went over Niagra in a barrel and survived.  Many others failed the latter part.
